TERMS AND CONDITIONS OF USE
These are the terms and conditions under which we (Missing Persons) provide our services to you (subscriber). Missing Persons and the Subscriber shall be jointly referred to as the “Parties”
Please read these terms and conditions carefully before you subscribe to our services, as they will inform you about our services, the extent of our liability to you and any amendments or termination hereof.
Note: When Signing up for any of the Missing Person services, you are entering accepting the terms and conditions of use mentioned below.
You can always access the terms of use for our services on the Missing Persons website.
1. Registration and creation of Missing person account:
a. In order for you to enjoy the full extent of our services, you will be required to
i) Register online at MissingPerson.com and create a user account with us
ii) Receive our services. Our services will enable you to search and upload personal information and images of Missing Persons to our database.
iii) We will also give you access to add-on services such as psychosocial support, listing extension, etc.
b. Once you register online, we shall send you an email activation link.
c. The Activation link sent to you will only be valid for a period of 24 hours from the time it is sent to you. Failure to use the Activation link within this stipulated time will invalidate your registration.
d. Once your account has been created you will receive a welcome email from us to the email address you have provided.
2. Personal Information
a. In order to provide you with the Missing Person services, we will require certain personal information from you. Please ensure that you provide us with the provided information accurately and within a reasonable time.
3. Changes & Cancellations
a. Missing Person Platform reserves the right to make minor changes to the platform to reflect changes in any relevant laws or regulatory requirements and or to implement minor technical adjustments and improvements to the way we deliver our services to you.
b. We may also make more significant changes to our terms of service, following which we will notify you of such changes as soon as practicable and within a reasonable time.
c. Should you no longer wish to subscribe to our platform as a result of the changes we make in our terms of service, then you can cancel your subscription by sending an e-mail stating your intentions to cancel to [email protected].

4. Our Services
a. Once we accept your user account registration, we agree to provide the following services to you for free under the following terms and conditions;
i. We shall allow you to register information about yourself and any alleged missing person in our database. You can add, remove, edit, or view that information by accessing your user account on our website at any time.
ii. We shall from time to time, as much as the law permits, make that information available to other subscribers and platform users who may use the information for public interest purposes and to help identify and or reunite missing persons with their loved ones. Kindly refer to our privacy policy for more details about how your information may be used or shared.
iii. You are obligated to provide us with accurate information about any person you wish to report missing or found on the platform. In light of the above and in order for your report to be verified on our platform, we will require you to provide and upload a police extract declaring said person missing while making the report on our platform.
iv. Our services do not give you any special recovery rights in relation to any report made. If the person you report missing is recovered by the Nigerian Police Force, the recovery will be explicitly subject to their own internal policies and procedures.
v. Your use of our services does not guarantee that the person you report missing will be recovered and returned. The recovery and return of all persons remain the purview of The Nigerian Police and theirs alone.
vi. Please note that we do not help search for missing persons. We only provide a platform to list persons with the hope that
it would increase the chances of missing people getting found.
vii. Listing someone on our site: is not equivalent to reporting to the Nigeria police or any other law enforcement agencies. The missing person
the platform is not a private investigative service nor is it an official reporting platform.
5. System Maintenance
a. Whilst we stand on our commitment to making sure our services are available to you at all reasonable times, we cannot guarantee a round-the-clock availability as we may from time to time take our services offline for maintenance purposes.
b. Whilst we undertake to do our best to provide a safe environment for users on our website, we do not guarantee holistic viral and bug-free protection and therefore urge users to use appropriate cyber protection software on the devices they use to visit our website and access our services.
6. Charges for Our Services
a. Our missing person’s services will be provided to you for free, while other add-on services will be provided at a fee. Please refer to our table of fees [www.missingpersonsplatform.com.ng] for more information about add-on services and subscription charges.
7. Duration of Services
a. Upon subscription you will be given access to our services through our website.
b. If you no longer wish to receive our services, you may communicate your intention to cancel by sending a request to us at missingpersons.com. We will administer this change within a reasonable time.
c. Please note that in the event that your subscription expires and you do not renew within 90 days from the date of expiry, your listings will be deleted from the platform and or servers.
d. If you decide to cancel of your own volition, you will not be eligible for a refund of any amount paid for add-on services rendered.
8. Our Rights to Cancel
a. We reserve the right to cancel or end the relationship between us on the following grounds:
i. When we are convinced that you have misused our services. For the purposes of these terms of use, a misuse shall include but is not limited to situations where you use our services in a way which is not permitted by the law and by these terms and conditions or where there is fraud or reasonable grounds to suspect fraud;
ii. When we have changed our terms of service and you do not agree with the changes made; or
iii. If any payment that you owe us is declined, rejected or reversed.
9. Password Security
a. We reserve the right to require you to change any or all of the passwords used by you in connection with your user account on our website and or our services.
10. Copyright & Intellectual Property
a. You hereby acknowledge and agree that all copyright, trademarks and all other intellectual property rights on our website, relating to our services and all aspects of them are owned by us.
11. Prior Understandings
a. These terms of service embody the entire agreement and understanding between parties hereto and supersede any and all prior agreements, arrangements and understandings relating to the use of our services herein.
b. We undertake to provide our services to you adhering to the terms set forth using reasonable care and skill.
12. Data Protection & Privacy Policy
a. In order to discharge our obligations towards you we will collect personal information in connection with your use of our services and our website. Kindly see our privacy policy for relevant information regarding that and any other related matters.
13. Customer Complaints Procedure
a. If you have any complaints in relation to our services, then please contact us at MissingPersons.com.
14. Force Majeure
a. We shall be under no liability for any delay or failure to deliver our services or otherwise perform any obligation under these terms and conditions if the delay or failure is caused by circumstances beyond our reasonable control.
15. Severability
a. If it is found in a final judgment by a court of competent jurisdiction (not subject to further appeal) that any term or provision hereof is invalid or unenforceable, (i) the remaining terms and provisions hereof shall be unimpaired and shall remain in full force and effect and (ii) the invalid or unenforceable provision or term shall be replaced by a term or provision that is valid and enforceable and that comes closest to expressing the intention of such invalid or unenforceable term or provision.
16. Jurisdiction
a. These terms and conditions are governed by and construed in accordance with all applicable Laws of the Federal Republic of Nigeria.
17. Transfer of Rights
a. We may transfer our rights and obligations under this arrangement to another organisation and shall notify of such transfer should we decide to do so.
